Newquay landlords fined over safety

THE LANDLORDS of a Newquay property have been fined for a catalogue of safety standards failures and ordered to pay fines and costs of more than £7,500.

Cornwall Council's private sector housing team successfully prosecuted Michelle and Stacey Bathe, of Cheriton Fitzpaine, Crediton, over the state of their rented house in Trebarwith Crescent, Newquay.

An unannounced inspection was made in May last year after concerns from Cornwall Fire and Rescue Service that the fire alarm at the building, classed as a house in multiple occupation, was not working.

Other necessary work included providing valid gas and electrical safety certificates and failing to maintain fire precautions. There was also general disrepair of the property and of the communal areas and garden.

The Bathes were informed of the breaches in writing but failed, over a significant period of time, to carry out the work. They did not attend the hearing at Truro Magistrates' Court last Friday and the case was proved in their absence.

The couple were each fined £3,000 and ordered to pay a victim surcharge of £120. Costs of £1,873 were awarded to Cornwall Council.

Cornwall Council said it wants to help tenants get a "better deal in Cornwall" and key to this is improving property standards in the private rented sector, identifying rogue landlords and taking steps to "drive them out of Cornwall".

Geoff Brown, Cornwall Council Cabinet member for homes and communities and Newquay Central ward member, said: "Cornwall Council values the contribution made by well-managed houses in multiple occupation within the local housing market but will continue to intervene in these types of property to ensure minimum standards are maintained.

"As indicated by this case there are landlords who flout the law by failing to ensure their properties are safe."

He added: "The private sector housing team will not hesitate to take action against irresponsible landlords."
